These Terms govern your use of Afterthought System, LLC ("we", "us", "our") and the PDFForge service ("Service"). By creating an account or using the Service, you agree to these Terms.
1. Who you're contracting with
The Service is operated by Afterthought System, LLC. If you're using the Service on behalf of an organization, you confirm you have authority to bind that organization to these Terms. If you're an individual, you confirm you are of legal age in your jurisdiction.
2. The Service
PDFForge lets you design PDF templates and generate documents from JSON payloads via an API. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan.
3. Your account
You're responsible for keeping your credentials and API keys confidential and for all activity under your account. Provide accurate information and keep it up to date.
4. Acceptable use
You must not:
- Use the Service for unlawful, fraudulent, or abusive purposes (including spam or phishing);
- Infringe intellectual property or privacy rights of others;
- Interfere with the Service's security, probe or scan it, or upload malware;
- Reverse engineer, resell, or redistribute the Service except as permitted by law;
- Circumvent technical limits, rate limits, or quotas.
5. Your content
You retain ownership of the data and content you submit. You grant us a limited license to host and process it solely to provide the Service. You're responsible for ensuring you have the rights to the content you upload.
6. Intellectual property
We retain all rights, title, and interest in the Service, including its software, design, and branding. No rights are granted except as expressly set out in these Terms.
7. Payments, billing, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Our refund policy is available at /refunds.
8. Service levels and warranties
The Service is provided "as is". We don't guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Liability
To the fullest extent permitted by law, our aggregate liability under these Terms is capped at the fees you paid us in the 12 months before the claim. We're not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where it cannot be excluded by law.
10. Indemnity
You'll indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
11. Suspension and termination
We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; you may export your data for 30 days after which it may be deleted.
12. Changes
We may update these Terms from time to time. Material changes will be communicated by email or in-app. Continued use after the effective date constitutes acceptance.
13. Governing law
These Terms are governed by the laws of Afterthought System, LLC's jurisdiction, and the courts of that jurisdiction have exclusive jurisdiction over any dispute.
